Terms of Service
The agreement between you and Founderboard for use of the platform.
1. Who we are
Founderboard is operated by IntoApps Holding B.V., Tilburg, The Netherlands ("Founderboard", "we", "us").
You can reach us at hello@founderboard.ai.
2. Acceptance
By creating an account, signing in, or using the platform at https://founderboard.ai (the "Service") you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the Service.
If you use the Service on behalf of an organisation, you confirm you are authorised to bind that organisation, and "you" means both you and that organisation.
3. What the Service is
Founderboard provides an AI advisory board and a set of structured working tools for people building a business. The Service includes:
- AI board members you can chat with, which respond using large language models;
- working tools (customer profiles, interviews, competitor analysis, value proposition and others) that store the content you enter;
- AI-generated summaries, board meetings, audio briefings, news commentary and reports;
- for accelerator programs, a coach console giving program staff a read on participating ventures.
4. Accounts
You must be at least 18 years old to use the Service. You are responsible for keeping your credentials confidential and for everything that happens under your account. Tell us at hello@founderboard.ai as soon as you suspect unauthorised access.
You must give accurate registration information and keep it current.
5. AI output — important limitations
The Service produces AI-generated output, and AI-generated output can be wrong.
- Output is generated by statistical models. It may be inaccurate, incomplete, outdated, biased, or fabricated, even when it reads as confident and specific.
- Output is not legal, financial, tax, investment, medical or other professional advice. The "board members" are software personas, not qualified advisers, and no adviser-client relationship is created.
- You are solely responsible for verifying output before acting on it and for every decision you make about your business.
- Similar prompts may produce different output for different users. We do not warrant that output is unique, original or non-infringing.
6. Your content
You keep all rights in the content you submit — venture descriptions, tool entries, messages, uploads ("Your Content").
You grant us a worldwide, non-exclusive, royalty-free licence to host, store, copy, transmit, display and process Your Content, and to pass it to the sub-processors listed in our sub-processor list, strictly for the purposes of operating, securing, supporting and improving the Service for you.
We do not sell Your Content, and we do not use it to train third-party foundation models.
7. Output ownership
As between you and us, and to the extent permitted by law, you own the output the Service generates in response to your inputs. We may generate similar or identical output for other users, and we retain all rights in the Service itself, including its prompts, board member definitions, tool designs, models routing and software.
8. Acceptable use
You may not:
- use the Service to break the law, infringe anyone's rights, or violate anyone's privacy;
- submit personal data about other people without a lawful basis to do so — in particular, do not paste customer interview recordings, health data or other special categories of personal data without the appropriate consent;
- attempt to extract, reverse-engineer, scrape or resell the Service, its prompts or its models;
- circumvent rate limits, usage limits, security controls or access controls;
- upload malware, or use the Service to generate spam, harassment, deceptive or illegal content;
- resell, sublicense or provide the Service to third parties except as expressly permitted.
We may suspend or terminate accounts that breach this section.
9. Accelerator programs and coach access
If your venture is enrolled in an accelerator or program that uses Founderboard, staff of that program can see your venture's board and tool content, your activity signals and progress metrics through the coach console.
Program staff cannot read your conversations with your AI board members. Chat content is excluded from every coach-facing surface and every generated coach report.
The program is a separate controller for the data it sees. Its own privacy notice governs what it does with that data.
10. Fees
Where the Service is offered free of charge or in beta, we may change, limit or discontinue it at any time. Where paid plans are offered, the price, billing period and refund terms presented at purchase apply, and fees are exclusive of VAT unless stated otherwise.
11. Beta features
Parts of the Service are marked beta or preview. They are provided as-is, may change or disappear, and may be less reliable. Do not rely on them for anything critical.
12. Availability
We aim for high availability but do not guarantee uninterrupted service. We may perform maintenance, change features, and impose usage limits. We rely on third-party providers (including AI model providers) whose availability we do not control.
13. Termination
You may stop using the Service at any time and delete your account from your profile page. We may suspend or terminate your access if you breach these terms, if required by law, or if we discontinue the Service.
On deletion, we handle your data as described in the Privacy Policy. Sections 5, 6, 7, 14, 15 and 17 survive termination.
14. Disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, accuracy of output, and non-infringement.
Nothing in these terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, fraud, or a consumer's non-excludable statutory rights.
15. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for lost profits, lost revenue, lost business, lost opportunity, or lost or corrupted data.
Our total aggregate liability arising out of or relating to the Service is limited to the greater of (a) the amounts you paid us for the Service in the twelve months before the event giving rise to the claim, and (b) EUR 100.
16. Indemnity
You will indemnify us against third-party claims arising from Your Content, your use of the Service in breach of these terms, or your infringement of anyone's rights.
17. Changes to these terms
We may update these terms. For material changes we will give notice in the product or by email at least 14 days before they take effect, and continued use after that date means you accept them. The version and effective date at the top of this page always identify the current version.
18. Governing law
These terms are governed by the laws of the Netherlands. Disputes go to the competent court in the Netherlands, without prejudice to any mandatory consumer protections in your country of residence.
